AND PROPERTY OWNERS
OF CLASS ACTION SETTLEMENT
To all persons
who on December 29, 2003 resided or
owned real property within approximately 2 mile of the former Garfield Alloys, Inc.
plant in Garfield Heights, Ohio.
A Settlement has been reached in the above‑captioned class action suit on behalf of a class of residents and property owners who resided or owned property within one-half mile of the Garfield Alloys plant in Garfield Heights, Ohio on December 29, 2003. The class approved by the court includes only those individuals residing or owning property within one-half mile of the Garfield Alloys plant in Garfield Heights, Ohio on December 29, 2003. The Settlement will secure a settlement fund of approximately $800,000 after expenses and attorney fees. The amount distributed to each claimant will be determined by the total number of approved claimants participating in the fund.
The Court has issued a Notice of Proposed Class Action Settlement ("Notice") which identifies the class members, identifying the designated streets deemed to be within one-half (1/2) mile of the Garfield Alloys Plant, the history of the case, the terms of the Proposed Settlement, and important information concerning the rights of members of the class. Class members who did not receive the Notice by mail may obtain a copy by referring to the websites of the attorneys for the class:
